Welcome to Bantu Data Services (BDS). These Terms and Conditions ("Terms") govern your access to and use of our website, data products, and services. By using our services, you agree to be bound by these Terms.

1. Description of Services

Bantu Data Services collects, cleans, structures, and sells datasets ("Datasets"). We offer two main services:

• Proprietary Datasets: Pre-compiled datasets available for direct purchase.
• Data on Demand: Custom dataset creation based on a client's specific requirements, provided after a quote is accepted and payment is made.

2. Data Licensing and Use

When you purchase a Dataset from BDS, you are granted a non-exclusive, non-transferable, worldwide license to use the data for your own internal business or research purposes.

You may not:

• Resell, sublicense, or redistribute the Dataset to any third party.
• Use the Dataset to build a competing data service.
• Publicly display the raw data from the Dataset without our express written permission.

You may:

• Use the data for internal analysis, modeling, and business intelligence.
• Create and publish aggregated or derivative works (e.g., charts, reports, analysis) based on the data, provided that the original raw data cannot be reverse-engineered from your work.

3. Quotes and Payment

For "Data on Demand" services, any quote we provide is valid for 30 days. The quote is a non-binding estimate until you have formally accepted it and we have confirmed the project. Full payment is required before the final Dataset is delivered. All fees are non-refundable once work has commenced or the data has been delivered.

4. Intellectual Property

All right, title, and interest in and to the Datasets, including all intellectual property rights, are and will remain the exclusive property of Bantu Data Services. The license granted in Section 2 does not transfer any ownership rights to you.

5. Disclaimer of Warranties

Our Datasets are provided "as is." While we strive for the highest level of accuracy, BDS does not warrant that the data will be error-free, complete, or uninterrupted. We disclaim all warranties, express or implied, including any warranties of accuracy, merchantability, and fitness for a particular purpose.

6. Limitation of Liability

To the fullest extent permitted by law, Bantu Data Services shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your use of our Datasets.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Manitoba and the federal laws of Canada applicable therein, without regard to its conflict of law provisions.

8. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this site. You are advised to review these Terms periodically for any changes.
